Prepare a Southold Permit Package That Survives Zoning, Wetland, Floodplain and Inspection Review

Southold does not use a simple construction-value formula or a general public building-permit application portal. The current process begins with a notarized Town application, a scaled survey, four professionally sealed plan sets and the required Suffolk County insurance and licensing documents.

This Southold-specific guide explains the correct Town Hall Annex, square-foot fees, permit-expiration rules, inspection stages, Certificates of Occupancy, rental permits, pre-1957 buildings, Greenport jurisdiction and North Fork coastal approvals.

Correct address, phone, hours and paper application package

Five Southold rules to know before filing Use the Building Department at 54375 Route 25/Main Road, not the main Town Hall. Submit four sealed plan sets. Electrical applications are filed separately. Final fees are calculated by the Department after the permit is written. No building may be occupied before the required Certificate of Occupancy is issued.

Town of Southold or Village of Greenport?

Use Southold Town Building Department

For property in Town hamlets and unincorporated areas, including:

  • Cutchogue
  • East Marion
  • Fishers Island
  • Greenport West
  • Laurel and Mattituck
  • New Suffolk, Orient, Peconic and Southold

Use Village of Greenport

The incorporated Village of Greenport has its own Building Department and Code Enforcement office.

Open the Village Building Department

Verify before filing

  1. Search the Town parcel map.
  2. Save the tax-map number.
  3. Check the municipal boundary.
  4. Call the responsible office when the parcel is near Greenport Village.
“Greenport” in a postal address is not enough. Greenport West is within Town jurisdiction, while property inside the incorporated Village follows the Village permit process.

Submit a Complete Southold Building Permit in Seven Steps

Verify Town jurisdiction
Check zoning, CO and coastal limits
Prepare survey and four plan sets
Collect licenses and insurance
Submit notarized application
Resolve reviews and pay final fee
Inspect and obtain CO

Verify the parcel and permit authority

Confirm that the property is within Town jurisdiction and save the Suffolk County tax-map number.

Check zoning, existing COs and outside approvals

Confirm permitted use, setbacks, lot coverage, height, existing structures and whether Planning, ZBA, Historic Preservation, Health, Trustees or DEC approval is needed.

Property-purchase checkpoint: Do not assume every structure visible on the survey appears on an existing Certificate of Occupancy.

Complete, sign and notarize the Town application

Describe the existing use, intended use, work, ownership and any covenants or restrictions accurately.

Applicant is not the owner: Include the original signed owner authorization.

Prepare the survey and four professionally sealed plan sets

The Town checklist requires a scaled survey or site plan and four sets bearing the signature and original seal of a New York licensed architect or professional engineer.

Survey should coordinate: Lot, buildings, adjoining property, public streets, waterways and proposed work.

Collect contractor licensing and insurance documents

Submit the Suffolk County contractor license, liability insurance, Workers’ Compensation certificate and Disability Benefits certificate or applicable exemption documents.

Electrical work: File the electrical application separately and use an electrician with an active Suffolk County license.

Deliver the complete package to the Building Department

Submit the package to the Town Hall Annex at 54375 Route 25/Main Road. Confirm whether staff prefer in-person delivery or will accept the package by mail.

Do not include a guessed final fee. The current application says the Department calculates final fees and collects them after the permit is written.

Display the permit, request inspections and obtain the CO

Keep the permit visible at the work site, leave required work exposed and complete every building, electrical, plumbing, Health and certification requirement.

No occupancy: The building may not be used in whole or in part until the Building Inspector issues the required Certificate of Occupancy.

Electrical application

File Electrical Work Separately

Licensed electrician

The Town building checklist says the electrician must have an active Suffolk County license.

Separate application

The electrical permit or inspection application is filed separately from the main building-permit package.

Separate fee schedule

The current posted residential electrical list begins at $100 for an area up to 500 square feet. Pool or hot-tub inspection is listed at $125, and an electrical survey at $120.

Permit validity

Start Within 12 Months and Finish Within 18 Months

Commencement deadline

The building application states that a permit expires when authorized work has not commenced within 12 months after issuance.

Completion deadline

The permit also expires when work has not been completed within 18 months after issuance.

Possible extension

When no intervening zoning amendment or other regulation affects the property, the Building Inspector may authorize one written six-month extension. A new permit is required after that.

Do not wait for the expiration date. Ask about an extension while the permit remains active and keep written proof of the Town’s decision.
Certificate of Occupancy closeout

Complete the Final Documents Before Requesting Occupancy

Common final items

  • All building inspections passed
  • Electrical inspection accepted
  • Plumber affidavit submitted
  • Suffolk Health approval submitted
  • Energy-code compliance completed
  • Requested professional certifications submitted
  • Final survey or as-built documents submitted
  • Outstanding fees paid

Before using the structure

  • Confirm all related permits are final.
  • Confirm the approved use matches the intended use.
  • Obtain the Certificate of Occupancy or other required completion certificate.
  • Save the final certificate with the deed and survey.
  • Do not occupy only because construction appears complete.
Occupancy is a separate approval. A completed building, passed trade inspection or paid permit does not replace the Certificate of Occupancy required by the Building Inspector.
Floodplain, wetlands and waterfront

North Fork Sites Can Require Several Separate Agencies

Town floodplain permit

May apply to buildings, additions, alterations, clearing, grading, excavation, paving, fill, drainage and watercourse changes.

Southold Town Trustees

The building checklist says a Trustee permit may be required for work within 100 feet of a tidal or freshwater wetland.

New York DEC

The checklist warns that DEC approval may be required within 300 feet of a tidal wetland or 100 feet of a freshwater wetland.

Coastal erosion area

Work near beaches, dunes, banks, bluffs or designated coastal erosion hazard areas can require additional review under Town and state rules.

Effective date

The 2025 New York State Uniform Code became effective December 31, 2025.

Energy Code

The 2025 New York State Energy Code and NYS ASHRAE 90.1-2025 also became mandatory for applications beginning December 31, 2025.

No application transition period

New applications submitted on or after that date must comply with the current 2025 code books and amendments.

Open the NYS Code Adoption Notice

Zoning denial and appeal

Use the Notice of Disapproval to Identify the Exact ZBA Relief

Obtain a current Notice of Disapproval

The Building Department identifies the zoning provision the proposal does not satisfy. The posted building fee for the notice is $100.

Prepare the ZBA survey and plans

Show existing and proposed setbacks, coverage, gross floor area, parking, wetlands, banks, bluffs and all structures.

Submit the correct variance or special-exception application

Use the application matching the requested relief rather than a generic letter.

Return to the Building Department after approval

ZBA relief does not itself authorize construction. The building permit and other agency approvals are still required.

Current-document requirement: Southold’s submission instructions generally call for a recent Notice of Disapproval and the survey or site plan filed with the Building Department. Confirm the permitted age of the notice before filing.

Rental and historic records

Rental Permit, Accessory Apartment and Pre-Existing CO Paths

Rental permit

Posted fee: $300

Renewal: Every two years

Accessory apartment

An accessory apartment can require ZBA special-exception approval, floor-area calculations, parking, CO records, deed, survey and interior and exterior photographs.

After zoning approval, the required building permit, inspections, CO and rental permit still apply.

Pre-existing Certificate of Occupancy

For an existing building dating before April 9, 1957, the posted application requests:

  • Accurate survey
  • Floor plan
  • $200 fee
  • Consent to inspection

Open the Pre-CO application

Eight or more rental units: The posted rental application requires site-manager information for rental properties containing eight or more units.
Permit and CO research

Find Southold Building Records Before Buying or Remodeling

Start with the property address and tax-map number

Use the Town parcel map to confirm the property, zoning and Suffolk County tax-map identifier.

Call the Building Department

Ask whether the Town has open permits, Notices of Disapproval, violations, Certificates of Occupancy or Pre-CO records for the parcel.

Use the public-records form for copies

Select Building as the department and describe the exact record, file title, date, address, permit number and tax-map number.

Check Planning records separately

Site-plan, subdivision and related Planning Board documents are maintained in the Town records system and can be searched using the tax-map number.

Compare every structure with the CO record

Confirm that the house, additions, decks, pools, garages, accessory structures and business uses shown on site are covered by the Town’s records.

Town response: The current online records-request form states that the Town will respond within five working days. A response is not necessarily the same as delivery of every requested record.

Frequently asked questions

Southold Building Department FAQs

What is the correct Southold Building Department address and phone number?

The Building Department is in the Town Hall Annex at 54375 Route 25, also called Main Road, Southold, NY 11971. The phone number is 631-765-1802. Office hours are Monday through Friday from 8:00 AM to 4:00 PM, except Town holidays.

Can I apply for a Southold building permit online?

The current official Building Department process centers on a downloadable, signed and notarized application with a scaled survey and four sealed plan sets. The Town’s online permit portal is for Town Clerk services such as beach and waste permits, not a general Building Department application portal.

How many sets of construction plans does Southold require?

The current Building Department checklist requires four sets of plans bearing the signature and original seal of a New York State licensed professional engineer or architect.

How much is a Southold residential building permit?

The posted fee for new dwellings, additions and alterations, including deck additions, is $250 plus $0.50 for each square foot of floor area. A separate $100 Certificate of Occupancy fee is listed for new dwellings, additions and alterations.

When does a Southold building permit expire?

The Town application states that a permit expires when work has not commenced within 12 months or has not been completed within 18 months after issuance. The Building Inspector may approve one additional six-month extension when no intervening zoning or regulatory change affects the property.

How do I schedule a Southold building inspection?

Call the Building Department at 631-765-1802 with the building-permit number ready, or use the Town’s Submit/Request page. Display the permit, keep approved plans available and leave all work required for inspection exposed.

Do electrical permits and inspections use the building application?

No. The Town checklist says the electrical application is filed separately and the electrician must have an active Suffolk County license. Electrical inspections also use a separate Town fee schedule.

Does work near a Southold wetland need another permit?

It may. The Building Department checklist says a Town Trustee permit may be required for work within 100 feet of a tidal or freshwater wetland. New York DEC approval may be required within 300 feet of a tidal wetland or 100 feet of a freshwater wetland. Floodplain and coastal-erosion review may also apply.

How do I obtain a Southold rental permit?

The posted rental permit fee is $300, and the application must be renewed every two years. The packet requests floor plans, CO or Pre-CO records and either a Town safety inspection or qualifying professional code-compliance certification.

How do I get a Certificate of Occupancy for a building constructed before 1957?

For a qualifying building existing before April 9, 1957, the Town’s Pre-Existing Certificate of Occupancy application requests an accurate survey, a floor plan, a $200 fee and consent to a Building Inspector’s inspection.
