Three Common Riverhead Projects Need a Closer Look

Shed

Riverhead allows a limited exception for one shed under 144 square feet on a single-family property when it is in the rear yard and at least 5 feet from property lines.

The exception may not work near wetlands, a bluff or inside the Pine Barrens Overlay District.

Fence

A conforming residential fence generally does not require a Building permit. Front-yard and street-side fencing is generally limited to 4 feet, while side and rear fencing can generally reach 6 feet.

Corner, through, wetland and bluff properties need staff review.

Pool or hot tub

New York requires permits for pools and hot tubs, including many temporary or storable pools.

The Town describes the exception as a pool designed for less than 24 inches of water depth and installed entirely above ground.

Exempt from a Building permit does not mean exempt from zoning or environmental law. Setbacks, easements, wetlands, floodplain, Pine Barrens, Health Department and private restrictions may still control the project.

Riverhead states that New York education law generally requires a New York-licensed design professional to stamp Building plans.

Plans must remain accurate, complete and drawn to scale even when a seal exception applies.

Limited alteration exception

The Town’s FAQ describes an exception for alterations costing $20,000 or less when they do not affect structural safety or public safety.

A simple basement finish without structural changes is the Town’s example, but the Building Inspector makes the project-specific determination.

Give Riverhead One Week’s Notice for Building Inspections

Inspection request email: buildinginspections@townofriverheadny.gov. Include the permit number, property address, inspection stage, requested date, applicant or contractor and site contact.

Confirm the permit is issued

Do not request an inspection for an application that has not been issued or begin work before the permit is obtained.

Request the first inspection within four months
